Cribs

Our work on behalf of parents of a child who died because of a defective baby crib not only resulted in a substantial settlement for the child’s parents, but also in the largest recall of full-sized cribs ever in the U.S. Three children died, seven were trapped and 55 others were involved in incidents related to a design flaw and hardware failure that causes the crib’s drop rail to separate from the frame.

Ladders

Our product liability attorneys successfully represented plaintiffs who were injured as a result of the defective and dangerous design of aluminum extension ladders that slip out while being used around the home. These clients sustained disabling and painful injuries including heel fractures and ruptured discs. These cases were settled for substantial amounts prior to trial or resulted in large jury verdicts after trial.

Clothing

We represented a 5-year-old boy who suffered third degree burns over 45 percent of his body when a T-shirt he was wearing caught fire and the flames could not be extinguished. The T-shirt was designed to change colors when exposed to different temperatures. Our attorneys learned that the special dying process used to make the shirt change colors also made it much more flammable than a normal cotton T-shirt. The case settled for a substantial amount prior to trial.

Utility Knife

We represented a 45-year-old artist who was permanently injured when the plastic housing of a utility knife came apart as he was using the knife to cut open a plastic paint bucket. He required surgery and suffers from nerve damage and permanent loss of function and strength of his left hand. Hersh & Hersh demonstrated an easy, alternative design that, if used by the manufacturer, would have prevented the injury to the plaintiff. The case settled just prior to trial.

Other Dangerous Products

Hersh & Hersh represented a client who suffered 1st, 2nd and 3rd degree burns on his legs when the teapot he bought at Peking Bazaar in San Francisco exploded and shattered as he poured hot water into it to prepare his morning tea. Hersh & Hersh pursued legal action against both the seller and the distributor. The box for the teapot advertised that it is resistant up to 120 degrees celsius.
