Clinical Trials Litigation
Clinical trials are tests conducted by manufacturers to determine the risks and benefits associated with use of a medical device or drug prior to and after marketing. In their haste to get drugs and medical devices to market, manufacturers often conduct clinical trials without proper concern for the safety of participants by failing to give participants information about possible side effects and/or by enrolling participants who do not actually need or qualify for the treatment being tested. Drug and medical device manufacturers enlist medical care providers to conduct the clinical trials creating a conflict of interest in which the patient’s medical care and safety is less important than obtaining clinical trial results.
