The term “qui tam” comes from a Latin phrase, “qui tam pro domino rege quam pro se ipso in hoc parte sequitur,” meaning “he who sues for the king as well as for himself.”

The whistleblower in a qui tam claim sues for the government as well as for himself or herself. Called the relator, the whistleblower provides evidence of fraud that allows the government to recover funds. The whistleblower receives a portion of the recovery.

The attorneys of Hersh & Hersh file qui tam claims on behalf of whistleblowers who report a broad range of fraud against the government, including:

Fraudulent use of government funds can include over-billing, billing for services not rendered, misappropriation of funds, embezzling and many other schemes for cheating taxpayers.

Our attorneys will analyze the facts of your case to determine if you have a valid qui tam claim. If so, we will file the lawsuit under seal to maintain your confidentiality. The government then reviews the case and determines whether or not to investigate it themselves. If they choose not to, our law firm will develop your case independently.

The amount of money you receive depends upon the how much the government recovers in the lawsuit and other factors. Generally, whistleblowers receive roughly 20 percent to 30 percent of the funds recovered.

If you have evidence of fraud against the government, contact Hersh & Hersh to arrange a free consultation and case evaluation. From our offices in San Francisco, California, our lawyers represent clients in whistleblower claims nationwide.
